Let us (tinu) keep email useful for personal communication

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

It amazes me; truly it does.

The power inherent in that single sentence, and the myriad misinterpretations that abound also.

These are famous words written over two hundred years ago; the authors are long passed. Yet the meaning is still patent and unambiguous, still contemporary, despite the form the words themselves take. Put into contemporary English, it might read thus:

The government has no place of right to control your speech or your thoughts in any fashion whatsoever. You may believe in and openly express your belief in any god(s), or other deities or a lack thereof as you see fit. You may speak your mind and express your opinions about any subject you wish without fear of reprisal from your government. You may gather in large numbers that you might speak with greater effect; and so long as your gathering does not interfere with others or become violent you will meet with no reprisals from your government. You may request aid of your government in resolving difficult issues when it is necessary that you do so, and you will at least be heard by your government.

Nowhere can be found the requirement that said beliefs and opinions must be acknowledged by anyone. Nowhere is anyone required to heed your diatribes. Nowhere is anyone barred from actively ignoring what you may be saying, or even telling you to be silent; others have the right to be left in peace if so desired, and none may violate this right. In fact, it is the government that is restricted, not individuals.

Yet misconstruction of these rights abound. Countless people claim the right to compel your acknowledgement of their speech; this is a misapprehension. Several think they may not be ignored or halted in their speech by others; this is also a falsehood. There are those who countenance the concept of their rights superceding yours in all ways; the most misguided of all are these.

All email, unfortunately including spam, is a form of speech. As speech, none are required to heed any email should they desire not to. Attempts to force recipients to accept and acknowledge any email by whatever means are rights violations committed against the recipient(s).

Also, advertisements of any kind (unfortunately even spam) are regarded as commercial speech, which enjoys far fewer protections against government and public interference than personal or private speech. Were this untrue, every single bill ever crafted into law regulating advertisements in any way would be unconstitutional and without compelling force. But these laws and regulations have force; you have rights as an individual.

Enforce your rights. Track down and complain about spammers because their few rights (if you really want to stretch the definition of rights that far) stop exactly where their actions infringe upon your many and greater rights.
